The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been stabilised. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of conflicting incidents captured the grim essence of the outgoing year. By day, diplomatic battles are waged: positive announcements are issued from various governments. Significant resources is expended on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the key method for achieving "resolution".

After-Dark Attacks

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is capable of detecting rocket firings from across the border, a capacity provided through up-to-date information. From observation points, defense planes that had been scrambled to counter approaching aerial threats streaked across the sky – sophisticated military planes supplied to Ukraine by Western partners.

Shortly after, Kyiv's anti-aircraft weapons engaged: defensive missiles deployed against a Russian ballistic missile. This was a sophisticated defense system at work, most likely delivered by partner states. Every deployment creates sudden vibrations, rattling buildings. The brief panic quickly becomes sober acceptance: possibly the approaching threat won't cause damage this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Soon after, a heavy machine gun fired at a aerial vehicle in the vicinity, part of a defensive team – almost certainly allied-provided weaponry. Unfortunately, the bullets missed the hostile drone – it maintained course toward its destination.

Periodically, this carried on until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, destruction and utility failures in many homes as a result of the nocturnal offensive. As typically, everyone still went about their day – living the war. But those full day demonstrated Ukraine's vital need on external assistance – a need that neighboring countries are demonstrably unable to replace in the short term.

Ineffective Peace Efforts

The detailed framework from Washington generated strong feelings, discussion and profound anxiety – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and multilateral gatherings.

Every new approach from American administration unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They contain the crisis but never actually secure success. This trend will, certainly, persist.

Tactical Assessments

It is tempting to accuse specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the whole story. US administration functions according to a premise familiar among experienced diplomats: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is unrealistic to force Russia to abandon the territory that it already controls in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, US leadership does minimal to discourage Russia, through words or deeds, from thinking that the situation will not shift further in its benefit in the coming year.

Divergent Views

Therefore, Moscow is certain that time is on his side – that Ukraine and its partners are approaching exhaustion. Their incentive to agree to terms that does not give them the maximum possible gain is close to zero. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's government remains supremely confident in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing civilians and areas but preventing a entire defensive failure until circumstances change in its advantage.

Existing Situation

Objectively, there are no actual prerequisites for a ceasefire. Now, individual motivations are becoming relevant: leadership ambitions to negotiate peace and achieve global acclaim, and Kyiv's double obstacles – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any plan Kyiv finds unworkable, so that their priority does not move to internal issues. And although their objective will now be much harder after current events, it remains quite doubtful that this will change their overall approach.

These opposing factors are driving the talks.

Assessment and Future

It took a only one week to eliminate the proposed articles of the latest plan. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the other European countries, along with soothing efforts of representatives, and finally, latest revelations, all did their job.

While new proposals based on established approaches are forthcoming, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to modify developments, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, mainly require ongoing international assistance.
